What To Do When Approached by Law Enforcement: Know Your Rights, Protect Your Future

1. You Have the Right to Remain Silent

You are not required to answer questions beyond identifying yourself. Politely say, “I am exercising my right to remain silent.” Talking too much—especially under stress—can lead to unintentional self-incrimination. The Constitution protects you. Use that protection.

2. You Have the Right to an Attorney

If you are being detained, arrested, or interrogated, clearly state:

“I want to speak to an attorney.”

After that, stop talking. Do not engage in small talk. Do not try to “explain yourself.” Let your attorney do the talking for you.

3. You Do Not Have to Consent to a Search

If officers ask to search your car, home, or belongings, you have the right to say no. Unless they have a warrant, probable cause, or your consent, a search is not automatically lawful. Clearly say:

“I do not consent to any searches.”

4. Don’t Run, Resist, or Argue

Even if you believe the stop is unfair or unlawful, do not resist physically or verbally. Comply with lawful commands and remember that your best defense is in the courtroom—not on the street.

5. Document the Encounter

If it’s safe to do so, record the interaction. Write down badge numbers, patrol car numbers, time, location, and details of the incident as soon as possible. Evidence is critical in defending your rights.
